Individuals under the age of 16 are deemed incapable of consent under all circumstances. Sexual intercourse with someone who is at least 16 years of age and less than 18 years of age is illegal unless the defendant is the victim’s spouse.
Definition of Offenses
|Sexual intercourse with a child age 16 or older||Sexual intercourse with someone at least 16 years of age and less than 18 years of age where the defendant is not the victim’s spouse.|
|2nd degree sexual assault||Sexual contact or sexual intercourse with someone at least 13 years of age and less than 16 years of age.|
|1st degree sexual assault||Sexual contact or sexual intercourse with someone less than 13 years of age.|
