A child under 16 years of age is unable to consent to sexual intercourse when the other person is more than 2 years older than him or her.[136] However, sexual contact with someone less than 15 years of age is illegal regardless of the age of the defendant.[137]

Definition of Offenses

Offense Definition
4th degree sexual assault[138] Sexual contact[139] with someone less than 15 years of age.[140]
2nd degree sexual assault[141] Sexual intercourse[142] with someone at least 13 years of age and less than 16 years of age where the defendant is more than 2 years older than the victim.
1st degree sexual assault[143] Sexual intercourse with someone less than 13 years of age where the defendant is more than 2 years older than the victim.
