Sexual acts with children less than 14 years of age are illegal under all circumstances.[278] An individual who is at least 14 years of age and less than 16 years of age cannot consent to a sexual act if the defendant is 4 or more years older than him or her and not his or her spouse.[279]

Definition of Offenses

Offense Definition
Indecent contact with a child[280] Indecent contact[281] with someone less than 14 years of age where the defendant is at least 18 years of age and not the victim’s spouse.
This law also applies to defendants at least 16 years of age and less than 18 years of age when the victim is at least 5 years younger than the defendant.
Lascivious acts with a child[282] Performing lascivious acts[283]—for the of arousing or satisfying the sexual desires of either party—with someone less than 14 years of age where the defendant is at least 18 years of age and not the victim’s spouse.
3rd degree sexual abuse[284] Committing a sex act[285] with someone at least 12 years of age and less than 14 years of age where the defendant is not victim’s spouse.
Committing a sex act with someone at least 14 years of age and less than 16 years of age where the defendant is at least 4 years older than the victim and not the victim’s spouse.
2nd degree sexual abuse Sexually abusing[286] someone less than 12 years of age.
