Comment: One comment requested the Secretary to clarify in the preamble that the privacy regulation does not preempt the Inspector General Act.

Response: We agree that to the extent the Inspector General Act requires uses or disclosures of protected health information, the privacy regulation does not preempt it. The final rule provides that to the extent required under section 201(a)(5) of the Act, nothing in this subchapter should be construed to diminish the authority of any Inspector General, including the authority provided in the Inspector General Act of 1978.
