In § 164.510 (k), we propose to permit covered entities to use or disclose protected health information in emergencies, consistent with applicable law and standards of ethical conduct, based on a reasonable belief that the use or disclosure is necessary to prevent or lessen a serious and imminent threat to the health or safety of any person or the public.
